The addendums to the contract of sale provide for the situation where the buyer does not intend to demolish the property and in which case, the buyer, in accordance with legislation will need to install smoke alarms, RCDs and obtain an Electrical Safety Certificate.

Important Information; the land is currently zoned R12.5 single residential. The Nedlands City Council (NCC) endorsed the proposed new Local Plan Scheme 3 (LPS3) which in relation to 13 Vincent St, up zoned the property from Single Residential R12.5 to multi-residential, R35. Under the NCC proposal, the property would become a triplex site.

In accordance with local government and planning legislation LPS3 was submitted to the Western Australian Planning Commission (WAPC).

The WAPC considered the proposed re-zonings to be insufficient and they have responded with alterations to LPS3 so as to up-zone the property from the proposed R35 to R160.

R160 is the highest multi-residential zoning and would permit a multi-story block of apartments, which could be up to 5 stories high and could have up to 2,000sqm of building area. Under that scenario, 10 units, each of 200sqm could be developed on the block.

The LPS3 changes as proposed by the WAPC have now been through the process of being advertised for public comment and submissions. The public submission period closed on 29th March and these will be reviewed by the NCC and then the WAPC. The WACP will make the final determination in relation to the various re-zoning options.

However, the potential buyers must make their own inquiries in relation to the number of units that can be built on the property.

Potential buyers cannot in any way rely upon these indications and must determine for themselves whether they believe the property zoning will change.
